As of January 1st, 2023, all manufacturers on the Italian territory are required to affix a specific label on their packaging. This label, affixed to any packaging (primary, secondary, and tertiary), shall indicate the nature of the packaging materials used to identify and classify them, by the procedures established by the applicable UNI technical standards and by the determinations adopted by the EU Commission.
To accelerate the transition to a circular economy, the Legislative Decree No. 116 of September 11th, 2020, was published in the Official Gazette on September 11th, 2020, which transposes the EU Directive 2018/851 on waste and Directive (EU) 2018/852 on packaging and packaging waste.
Leg. Decree 116 made amendments to Leg. Decree No. 152 of April 3rd, 2006 (Consolidated Environmental Act), on the subject of “Criteria informing packaging waste management activities”, which transposes and strengthens the provisions of Article 8(2) of Directive 94/62/EC.
On Nov. 21st, 2022, MASE-the Ministry of Environment and Energy Security-published Ministerial Decree 360 of Sept. 28th, 2022, which adopts the “Guidelines on Packaging Labeling” pursuant to Article 219, Paragraph 5 of the Consolidated Environmental Act. These guidelines aim to regulate the proper fulfilment of packaging labeling obligations to facilitate the end user and encourage the collection, reuse, recovery, and recycling of packaging. They also clarify that the use of digital channels, such as Apps, QR codes, or websites to replace or supplement the information on the packaging is envisaged.
Finally, Legislative Decree 228/2021 stipulates that all products, placed on the market before December 31st, 2022, and lacking the new environmental labeling requirements, can still be marketed until stocks are exhausted.
